Thirty law postgraduate students from Lancang Kuning University Pekan Baru (Unilak) visited the Constitutional Court on Monday (5/11/2018). Through Constitutional Court researcher Andriani Wahyuningtyas Novitasari all students gained knowledge related to the functions and authorities of the Constitutional Court as a judiciary in Indonesia. The students were accompanied by Unilak constitutional law lecturer Bagio Kadaryanto and business law lecturer Sandra Dewi.
Bagio revealed that the visit was aimed at learning about the functions and authorities of the Constitutional Court. It is also a pre-requisite for Unilak law postgraduate students.
Andriani began her presentation by elaborating the history of constitutional court first proposed in 1919 by Austrian legal expert Hans Kelsen (1881-1973). Kelsen spoke of a legislative agency to review the constitutionality of laws and to revoke unconstitutional laws. She said that the Constitutional Court is a product of the fourth amendment to the 1945 Constitution. "So, the Constitutional Court is a constitutional judiciary that emphasizes on toetsingsrecth and is a judiciary that handles megapolitical cases," Andriani explained.
She then talked about the nine constitutional justices and the procedural law in the Constitutional Court. She said that constitutional justices must be statespersons who are familiar with constitutional law and are able to resolve various constitutional issues that follow the dynamics of the constitutional life in Indonesia.
