Deputy Chief Justice Aswanto opened a national seminar on the Moderation Policy of Capital Punishment at the Multipurpose Hall of the Law Faculty of Padjajaran University Bandung, Friday (14/9/2018). Deputy Chief Justice Aswanto was a keynote speaker at the seminar, along with Constitutional Justice I Dewa Gede Palguna, Former Supreme Court Chief Justice Bagir Manan, and Komariah Emong Sapardjaya.
In his speech, Justice Aswanto said that capital punishment was decided by the Constitutional Court in Decisions No. 2 and 3/PUU-V/2007. In the decisions, the Court states that capital punishment is not contrary to Article 28 of the 1945 Constitution. The Court also elaborates that capital punishment is no longer a predicate sentence, but is a special, alternative sentence.
He added that capital punishment cannot be given to minors, pregnant women until they give birth, and to convicts who have intellectual deficits until they recover. (Hidayat/LA/Yuniar Widiastuti)
