Petition on Cirebon Regency Election Not Granted

The 2018 Cirebon regency election results dispute case petitioned by Candidate Pair Number 1 Kalinga-Dian Hermawa Susanti was not granted. The dismissal ruling was read out by Chief Constitutional Justice Anwar Usman before the other constitutional justices on Thursday (9/8/2018).

Deputy Chief Constitutional Justice Aswanto read out the legal consideration to case No. 15/PHP.BUP-XVI/2018 in which the Court considered the exception by the Respondent and Relevant Party that the petition had passed the deadline.

"Petitioners\' petition was submitted to the Registrar\'s Office on Monday, July 9, 2018 at 15:55 WIB […] past the [deadline] as determined by laws and regulations. Considering that even if the petition had not passed the deadline as determined by the legislation, based on facts and evidence at the hearing that the vote margin between the Petitioners and the Relevant Party exceeded the threshold determined by Article 158 of Law Number 10 of 2016 and Article 7 of the Constitutional Court Regulation Number 5 of 2017," Justice Aswanto said.

In the hearing, the Court also ruled for the petitions on the 2018 election results dispute of South Aceh Regency (66/PHP.BUP-XVI/2018), Subulussalam City (57/PHP.KOT-XVI/2018), and Tabalong Regency (26/PHP.BUP-XVI/2018).
