Passing Deadline, Petition on Konawe Regency Election Dismissed

The Constitutional Court (MK) held a ruling hearing of several 2018 regional head election disputes on Thursday (9/8/2018) in the Plenary Courtroom of the Constitutional Court. They are cases No. 54/PHP.BUP-XVI/2018, 50/PHP.BUP-XVI/2018, 55/PHP.BUP-XVI/2018, 17/PHP.BUP-XVI/2018, 45/PHP.BUP-XVI/2018, and 65/PHP.BUP-XVI/2018.

The Court stated that the petition No. 54/PHP.BUP-XVI/2018 filed by 2018 Konawe regent-vice regent Candidate Pair Number 2 Litanto-Murni Tombili had passed the deadline according to PMK No. 5/2017, which was three days after the Respondent announce the determination of the election results. Therefore, the Court dismissed the petition.

Past Deadline

In the same session, the petitions No. 50/PHP.BUP-XVI/2018 and 55/PHP.BUP-XVI/2018 on the 2018 election results dispute of Kolaka and Parigi Moutong Regencies were also rejected on account of having passed the deadline. Based on the Kolaka Regency KPU Decree No. 102/PL.03.6-Kpt/7401/KPU-Kab/VII/2018, the recapitulation results was announced on Thursday-Monday, July 5-9, 2018 at 00:00 WIB. However, the petition was filed to the Court on Thursday, July 12, 2018 at 16:33 WIB.

Wrong Object

The Court declared that the petition No. 17/PHP.BUP-XVI/2018 filed by 2018 Bantaeng regent-vice regent Candidate Pair Number 2 Andi Sugiarti Mangun Karim-Andi Mapaptoba had the wrong object as they did not question the error in the results of the vote count done by Bantaeng KPU and did not clarify their version of the correct results as stipulated by Article 8 paragraph (1) letter b number 4 and number 5 of PMK No. 5/2017. Therefore, the Court was not authorized to adjudicate for the case.

Petitions Dismissed

The Court dismissed the petitions No. 65/PHP.BUP-XVI/2018 and 45/PHP.BUP-XVI/2018 on the 2018 election results dispute of Padang Lawas and Sinjai Regencies. (Sri Pujianti/LA)
