The Constitutional Court held the second hearing of the judicial review of Article 80A of Law No. 16/2017 on the Stipulation of Government Regulation in Lieu of Law No. 2/2017 on the Amendment of Law No. 17/2013 on Mass Organizations into a Law to the Constitutional Court on Monday (11/12). The case file by Muhammad Hafidz and Abda Khair Mufti was presided over by Deputy Chief Justice Anwar Usman accompanied by Constitutional Justices Maria Farida Indrati and I Dewa Gede Palguna.
In the revision hearing, Muhamad Sahal as the Petitioners’ attorney delivered the principal points of the revision to the petition, including the argument that strengthens the Petitioners’ legal standing. Their standing is as a mass organization by the name of Perkumpulan Tuna Karya untuk Konstitusi Indonesia (Perak Indonesia).
“In the minute, it has been submitted as additional evidence and is being submitted to a notary, and when the deed is published, it will be submitted in the next hearing,” Sahal said.
According to the Petitioners, on October 24, 2017, the House of Representatives (DPR) approved the Regulation in Lieu of Law (Perppu) No. 2/2017 on the Amendment of Law No. 17/2013 of the Republic of Indonesia on Mass Organizations into a Law. The Petitioners claim that the provisions of article 80A of the Mass Organization Law are also related to the revocation of legal entities of mass organizations through dissolution without due process due of the law. This, according to the Petitioners, has ignored the law as the principle of the state of Indonesia and is contrary to the principle of upholding the law with no exception.
Before concluding the session, Deputy Chief Justice Anwar Usman approved the evidence of Case No. 94/PUU-XV/2017. “Therefore, the results of the hearing will be submitted to the Justices’ Deliberation Meeting and please the Petitioners wait for further notification from the Registrar’s Office,” said Deputy Chief Justice Anwar Usman concluding the hearing.
