The Constitutional Court (MK) held a workshop on "Operational Audits and Investigative Audits in the Registrar\'s Office and the Secretariat General of the Constitutional Court" for two days, Wednesday-Thursday (8-9/11) at Santika Hotel, Bekasi. The Secretary General of the Constitutional Court M. Guntur Hamzah opened the event, which was followed by a number of Commitment Maker Officials (PPK) in each working unit in the Registrar and Secretariat General of the Constitutional Court.

In his speech, Guntur said that this event was an important activity in providing information to carry out internal audits and operational audits according to the existing auditing procedures principles. This event was not only important for auditors, but also for PPK in every working unit.

Guntur stressed the importance of supervision in a state institution, especially since the budget is taken from the state budget (APBN), therefore there must be accountability for its use. He warned that the use of the budget should not only be based on existing regulations, but also must consider the principles of efficient budgeting in accordance with the needs.

Guntur also requested that every supervision and PPK in the Registrar and Secretariat General of the Constitutional Court care about office activities. According to him, supervision should begin thoroughly, starting from the planning process until the end. "All of these should include supervision, but if there is a violation, there will be an investigative audit. Therefore, this good opportunity should be used to explore information and materials on supervision. Don\'t think that supervision is only the duty of the planning and supervision division, but that it can be done by all divisions. We must watch each other," he said.

Becoming a Reliable Institution

Furthermore, Guntur hoped that the Constitutional Court can work in accordance with its mission as a modern and reliable judiciary. In addition, the Court should not only reflect formal truth. "The Constitutional Court should reflect not only formal truth but also substantive truth. Formal truth can be completed but in it there could still be corruption, unlike substantive truth," Guntur explained.

Guntur also reminded employees to be wary of two aspects of corrupt behavior. These two aspects are corruptive by attitude and corruptive by omission. Corruptive by attitude, continued Guntur, shows the behavior of someone who is problematic or corrupt because he/she sees everything based on the benefits he/she will obtain. However, there is another aspect, corruptive by omission. Guntur calls people with this behavior actually good people who let deviant behavior happen around them. "For example, letting a friend do deviant acts or allowing a friend letting a friend do deviant acts. Supervision is not only the duty of the Planning and Supervision Division, but the duty of all employees of the Constitutional Court. Every employee should remind each other," Guntur said.

On that occasion, Guntur also delivered a material on the "Supervision Policies in the Registrar and the Secretariat General of the Constitutional Court". He said the Constitutional Court would have an inspectorate as a supervisor in accordance with Presidential Regulation No. 65/2017. The system adopts one applied in Germany. Later, Guntur continued, the inspectorate would double as chairman of the anti-corruption supervisory committee. "There will be two KPKs in the Constitutional Court, the Performance Supervisory Commission and the Financial Supervisory Commission. The supervisors are expected to become an extension of the secretary general," he said.

In addition, Guntur expected that this workshop would strengthen the foundation of the Constitutional Court to face the 2018 Election of regional heads and legislative members as well as the 2019 Election of the president and vice president. Such heavy duty requires careful preparation on human resources. "This is necessary so that nothing will destabilize and disrupt the implementation of the tasks and performance the Constitutional Court," Guntur stressed.

During the event, several speakers from the Development Finance Comptroller (BPKP) who presented materials on internal audits and operational audits. The Director of PLPB Law Enforcement and Secretariat of Highest and Higher State Institutions Darius delivered the material on internal audits. Darius describes internal audit as the entire process of auditing, reviewing, monitoring, evaluating, and supervising.
