Chief Constitutional Justice Arief Hidayat attended “The 1st Indonesian Human Resources Journey Expo 2017” workshop in collaboration with the Alumni Association of the Diponegoro University Law Faculty (IKA UNDIP) and UNDIP Career Center on Tuesday (3/10/2017) at the Trans Luxury Hotel, Bandung. The event was aimed at expanding the participants’ horizons of the basic knowledge in human resources.
Justice Arief delivered a keynote speech on "Judicial Review of Labor Law in the Constitutional Court Perspective." He stressed that through its authority to examine laws against the Constitution, the Constitutional Court functions as the sole interpreter of the Constitution. According to him, the interpretation is set forth in a decision so that it applies and has binding legal force. The Constitutional Court\'s decision is final and binding since it is pronounced in a plenary session. "Because it has obtained legal power, the Constitutional Court\'s decision has legal consequences for all parties relating to the verdict, not the litigants," Justice Arief said before the participants in the event.
Justice Arief stressed that in the constitutional supremacy that the 1945 Constitution affirms, the Constitutional Court’s decision is binding and shall be obeyed and implemented. Legal policies formulated must form the basis of legal policies. For the sake of the enactment of the 1945 Constitution, he also appealed to the participants to respect the authority of state institutions as stipulated in the 1945 Constitution.
