The preliminary hearing of the judicial review of Law No. 30/2014 on Government Administration was held by the Constitutional Court (MK) on Wednesday (4/10) afternoon. Richard Christoforus Massa is registered as Petitioner for the Case No. 77/PUU-XV/2017.

Petitioner is an individual citizen of Indonesia who works as President Director of PT Nusantara Ragawisata since 2003. Petitioner requested a review against Article 53 paragraph (5) of Law No. 30/2014 which reads, "The court shall decide upon the petition as referred to in paragraph (4) no later than 21 (twenty one) working days after the petition is filed."

The Petitioner\'s attorney Muhammad Asrun explained that the Petitioner had faced a lawsuit related to PT Nusantara Ragawisata, especially the SHGB of land asset No. No. 74/Ungasan and SHGB No. 72/Ungasan won by PT Nusantara Ragawisata with court decisions deciding that SHGB of land No. 74/Ungasan and SHGB No. 72/Ungasan belonged to PT Nusantara Ragawisata.

In the trial process, Denpasar PTUN did not give an opportunity to the Petitioner to be heard as the President Director of PT Nusantara Ragawisata who can give explanation related to the legal status of both landThe a quo provision has violated the Petitioner\'s rights as Relevant Party or Intervening Defendant II in the examination of Positive Fictitious Application filed by PT Knightbright Luxury. In addition, the Petitioner may also retain his property that is under his control and private ownership. The Petitioner also claim that PTUN Denpasar denied him an opportunity to file a positive fictitious since the a quo law does not regulate the Relevant Party in the examination of an a quo positive fictitious appeal.
