Revote in Intan Jaya Ran Smoothly under Certain Conditions

The Constitutional Court (MK) once again held the trial of the Election Dispute of Regent and Vice Regent of Intan Jaya on Wednesday (2/8) with the agenda of listening to the re-voting report by KPU Intan Jaya, KPU Papua Province, and the Elections Supervisory Agency (Bawaslu). Previously, in the Verdict Number 54/PHP.BUP-XV/2017, the Court ordered Papua Province KPU to carry out a revote in seven polling stations in Intan Jaya Regency.

Represented by Ali Nurdin, KPU Intan Jaya stated that a revote had been conducted on July 11, 2017 in 7 polling stations (TPS), namely TPS 1, TPS 2, TPS 3, and TPS 4 of Emondi Hamlet, Sugapa Sub-district; TPS 1 of Soali Hamlet, TPS 2 Unabundoga Hamlet, and TPS 1 Tausiga Hamlet, Agisiga District.

"The revote was held on July 11, 2017 at 7 polling stations and in general the process went smoothly and safely, and there were no violations. The revote took place from 07.00-13.00 WIT (IEST), followed by vote counting," Ali elaborated.

However, through his report, Ali also mentioned several notes for the Court to consider in deciding the case. For one, KPU Intan Jaya received an objection report from Candidate Pair Number 3 Natalis Tabuni and Yann Robert Kobogoyauw in Agisiga District.

"There is an objection on the vote count for Candidate Pairs Numbers 2 and 3 because the community agreed for the votes to be divided between the two, but they were not. So, Candidate Pair Number 3 filed an objection," explained Ali at a session led by the Chief Justice of the Constitutional Court, Arief Hidayat.

Next, Bawaslu of Papua Province represented by Fegie Y. Wattimena explained that his side served as supervisory team because the Elections Supervisory Committee (Panwaslu) team was not working properly. In his notes, Fegie mentioned the incident in the form of a campaign by the Candidate Pair Number 3 team before the election. In addition, at TPS 2 of Unabundoga Hamlet, there was an incident where the community agreed to vote, but Candidate Pair Number 3 encouraged the community to vote for Candidate Pairs Number 1 and 3.

Bawaslu through Rahmat Bagja confirmed the report from KPU Intan Jaya that there was objection from Candidate Pair Number 3 on the recapitulation of the election of Intan Jaya Regent and Vice Regent. In his report, Rahmat mentioned that the recapitulation took place at 17:00 WIT with police supervision and Bawaslu requested that Candidate Pair No. 3 make a written report on their objection.

The revote in the 7 TPS resulted in Candidate Pair Number 1 Bartolomeus Mirip and Deny Miagoni receiving 120 votes, Number 2 Yulius Yapugau and Yunus Kalabetme (Relevant Party) receiving 1,076 votes, Number 3 Natalis Tabuni and Yann Robert Kobogoyauw (Petitioners) receiving 2,004, and Number 4 Tobias Zonngonau and Hermanus Miagoni receiving 0 vote. As for the result of the initial vote, Candidate Pair Number 1 received 8,636 votes, Number 2 33,958, Number 3 31,476, while Number 4 1,928 votes.
