The Constitutional Court declares Central Kalimantan candidate pair Yosep-Anwar’s lawsuit concerning regional election dispute inadmissible. The verdict confirms their rival, candidate pair Sabran-Said Ismail, as Central Kalimantan elected governor-deputy governor.
“Judicial verdict grants Respondent’s and Related Party’s exceptions regarding Applicant’s legal standing and declares Applicant’s lawsuit inadmissible,” said Chief Justice Arief Hidayat accompanied by eight other Constitutional Justices in verdict announcement session of Case No. 149/PHP.BUP-XIV/2016, on Monday (7/3) in Plenary Room, the Constitutional Court Building.
As stated in Court’s Consideration, the Court assessed Applicant’s lawsuit didn’t fulfill 1.5% maximum vote margin requirement as regulated in Article 158 Act 8/2015 and Article 6 Constitutional Court Regulation 1-5/2015.
“The Applicant gathers 488,218 votes, while the Related Party (most vote candidate pair, ed) gathers 518,895 votes. The margin between both is 30,677 votes or 5.9%, so the margin exceeds maximum margin,” explained Constitutional Justice Aswanto reading Court’s Opinion.
Therefore under legal consideration above, the Court argued Applicant’s lawsuit didn’t fulfill the requirements as regulated in Article 158 Act 8/2015 and Article 6 Constitutional Court Regulation 1-5/2015. (Panji Erawan/lul/Prasetyo Adi N)
