The Constitutional Court held judicial review session on Act No. 3 Year 2015 as Amendment of Act No 27 Year 2014 of 2015 Revised State Budget, on Monday (7/3) in Plenary Room, the Constitutional Court Building. One of the Applicants Cepi Supandi explained his side had done revision as followed; writing systematic improvement, assertion on Court’s jurisdiction towards petition object, improvement on Applicants’ legal standing, and petition demands addition as advised by Justice Panel. The Applicants had included 4 items of evidence for consideration. They requested the Court to declare Article 23A Act of 2015 Revised State Budget contrary to the 1945 Constitution.
“Basically, we humbly request the fairest decision from the Constitutional Court. Thank you, Your Honor,” said Cepi in front of Justice Panel led by Chief Justice Arief Hidayat.
Previously, the Applicants were objected with state capital injections (PMN) from the Government Investment Center for state-owned enterprises (BUMN) as regulated in Article 23A Act a quo. They assessed the provision was incorrect because it contrary to efficiency and independency principles.
They exemplified on Constitutional Court Verdict No 91/PUU-XIII/2015 which shown state capital injections for state-owned enterprises was a big problem.
Moreover, the Applicants said the House of Representatives had rejected the provision under the same reason with Applicants’ arguments. “Rejection on state capital injection granting for state-owned enterprises in 2016 State Budget is clearly refer to norm violations and/or economy principles as regulated in Article 33 (4) the 1945 Constitution,” they explained.
