The Constitutional Court rejects South Solok candidate pair Khairunas-Edi Susanto’s lawsuit. Chief Justice Arief Hidayat read the verdict in verdict announcement session, on Tuesday (16/2), in Plenary Room, the Constitutional Court Building. “Reject Applicant’s lawsuit in its entirely,” said him accompanied by eight other Constitutional Justices.

The Court declared Applicant’s argument concerning C6-KWK forms was irrelevant. “The Applicant got the most votes or even got absolute winning in several polling stations that concerned by the Applicant,” said Constitutional Justice Sitompul reading legal consideration.

As known, the Applicant concerned about C6-KWK forms in four districts; Sangir, Sangir Batang Hari, Sangir Jujuan, and Sangir Balai Janggo. Whereas vote recapitulation in those districts was as followed; the Applicant and the Related Party got 15,488 votes and 5,256 votes respectively in Sangir district; got 3,680 and 3,117 votes respectively in Sangir Batang Hari; got 4,111 and 2,875 votes respectively in Sangir Jujuan; and got 4,433 and 2,445 votes respectively in Sangir Balai Janggo.

The Court assessed Applicant’s request for adding 833 votes has no legal ground. The Court argued there was no certainty that voters would chose the Applicant if the forms delivered to them.

Regarding Applicant’s argument saying there was black campaign addressed to them, the Court argued the argument was unproven and had been refuted by M. Yasin’s (Related Party’s witness) testimony. As known, Yasin explained that regent candidate Muzni Zakaria never asked for support when delivering preach in Koto Baru Great Mosque.

Previously, the Applicant argued fraud and recapitulation error were occurred in South Solok election. The Applicant whose vote only differ around 1,33% with the Related Party argued recapitulation error was caused by errors in data collection which violated election principles, undistributed C6 forms, money politics, black campaign, regional government’s intervention, and civil servants involvement in the election.
