On the last day of dismissal verdict session, the Constitutional Court annulled seven lawsuits in session 1, on Tuesday (26/1) in Plenary Room, the Constitutional Court Building. Chief Justice Arief Hidayat read the verdict accompanied by eight other Constitutional Justices.
The lawsuits were as followed: Keerom (No. 119/PHP.BUP-XIV/2016), Pegunungan Bintang (No. 28/PHP.BUP-XIV/2016), North Minahasa (97/PHP.BUP-XIV/2016), Ternate (No. 112/PHP.KOT-XIV/2016), Musi Rawas (No. 113/PHP.BUP-XIV/2016), Sumenep (No. 135/PHP.BUP-XIV/2016), and Merauke (No. 85/PHP.BUP-XIV/2016) lawsuits.
The Court assessed all of the lawsuit didn’t fulfill vote margin requirements as regulated in Article 158 Act 8/2015 and Article 6 Constitutional Court Regulation No. 1-5/2015.
In Court’s Opinion, the Court considered Sumenep election commission’s exception regarding Applicant’s legal standing. The election commission as Respondent explained that the Applicant didn’t fulfill 0.5% maximum vote margin. As known, the margin for Sumenep election whose population number 1,114,882 was determined 0.5 %, as regulated in Constitutional Court Regulation No. 1-5/2015.
“Based on the data aforementioned, maximum vote margin between the Applicant and the most vote candidate pair (Related Pair, ed.) is 0.5% multiplied with 301,887; the result is 1,509 votes. Whereas, vote margin between the Applicant with the Related Party is 10,108 votes (3.35%), therefore the margin exceeds maximum vote margin,” said Constitutional Justice Manahan MP Sitompul.
Manahan explained that Applicant’s lawsuit didn’t fulfill requirements as determined in Article 158 Act 8/2015 and Article 6 Constitutional Court Regulation 1-5/2015. Therefore, the Court assessed Respondent’s and Related Party’s exceptions concerning Applicant’s legal standing, had legal grounds.
“Considering Respondent’s and Related Party’s exceptions concerning Applicant’s legal standing had legal grounds, Applicant’s lawsuits points as well as other exceptions from Respondent and Related Party are not taken into consideration,” said Manahan.
Similar to Sumenep lawsuit, the Court also decided eight other lawsuits inadmissible due to unfulfilled 0.5%-2% maximum vote margin in accordance to each respective region’s population number. (Lulu Anjarsari/lul/Prasetyo Adi N)
