The Court declared eight regional election dispute lawsuits inadmissible. Chief Justice Arief Hidayat read the verdicts with eight Constitutional Justices, on Thursday (21/1) morning, in Plenary Room, the Constitutional Court Building. The Court assessed all eight lawsuits didn’t fulfill vote margin requirement as stipulated in Article 158 Act 8 Year 2015 and Article 6 Constitutional Court Regulation Number 1-5 Year 2015.
The lawsuits were Ogan Ilir (Case No. 8/PHP.BUP-XIV/2016), West Halmahera (Case No. 11/PHP.BUP-XIV/2016 and No. 17/PHP.BUP-XIV/2016) Ponorogo (Case No. 12/PHP.BUP-XIV/2016), Pangkajene Islands (Case No. 18/PHP.BUP-XIV/2016), Malang (Case No. 79/PHP.BUP-XIV/2016), Barru (Case No. 105/PHP.BUP-XIV/2016), and North Halmahera (Case No. 108/PHP.BUP-XIV/2016) lawsuits.
The Court assessed vote margin requirement for Malang election dispute whose population number 2,429,292, was 0.5% margin. Applicant Rumpoko-Hadi pair who gained 521,928 votes had vote margin 13.85% with the Related Party who gained 83,889 votes, therefore the Court considered Applicant’s vote margin exceeded the determined margin.
Constitutional Justice Manahan Sitompul explained that Applicant’s lawsuit didn’t fulfill the requirements as stipulated in Article 158 Act Number 8 Year 2015 and Article 6 Constitutional Court Regulation Number 1-5 Year 2015. Therefore according to the Court, Respondent’s and Related Party’s exceptions regarding Applicant’s legal standing had legal grounds, Sitompul added.
“Hence Respondent’s and Related Party’s exceptions regarding Applicant’s legal standing had legal grounds, Applicant’s petition as well as Respondent’s and Related Party’s other exceptions are not taken into consideration,” Sitompul explained.
The Court also declared seven other lawsuits didn’t fulfill 0.5%-2% vote margin which determined based on population number. Previously, Justice Panel declared 40 lawsuits inadmissible due to lawsuit filing deadline and lawsuit withdrawal. (Lulu Anjarsari/lul/Prasetyo Adi N)
