Polling station working committee members never vandalized ballot boxes in Lintabuo district, Tanah Datar election commission as Respondent delivered in further session of Case Number 76/PHP.BUP-XIV/2016 on Thursday (14/1) in Panel Session Room 1, the Constitutional Court Building.
“Such allegation was never occurred, vote recapitulation in Lintabuo was safely done without any objection from participating witnesses,” said Respondent’s Attorney Sudi Prayitno.
Regarding Applicant’s objection to regent candidate Irdinansyah Tarmizi’s former convict status, the Respondent argued the objection had no legal ground. The Respondent assessed convict status didn’t hamper a person’s candidacy. “The person referred had submitted an affidavit saying never sentenced imprisonment based on binding verdict from Batu Sangkar district court (PN Batu Sangkar, ed.),” said Prayitno.

Meanwhile, Musi Rawas election commission denied entire candidate pair Ratna Machmud-Nawawi’s arguments. The Respondent denied Applicant’s claim saying the Applicant lost vote amounted to 5,437 votes, however they admitted that the Applicant once filed an objection.
“Candidate pair number 2’s witnesses were objected with the result (election result, ed.) and requested to us to crosscheck the result with DA-KWK and DA-1 KWK Plano forms. Therefore, the Respondent took the Plano forms from ballot box. It turned out that the Plano forms weren’t in the box. Thus, witnesses and Musirawas election monitoring committee agreed to use DAA-KWK Model forms which belong to Musirawas election monitoring committee as recapitulation basis,” said Respondent’s Attorney Yudi Wahyudi.
In the session, Justice Panel 1 also examined Respondent’s, Related Party’s, and Testimony Giver Party’s answers regarding Ketapang regent-deputy regent candidate pair Andi Djamiruddin-Chanisius Kuan’s lawsuit (Case No. 145/PHP.BUP-XIV/2016) and Kapuas Hulu regent-deputy regent candidate pair Fransiskus Diaan-Andi Aswad’s lawsuit (Case No. 132/PHP.BUP-XIV/2016).
