The Constitutional Court again held Boven Digoel election dispute further session on Wednesday (13/1) in Panel Session Room 1, the Constitutional Court Building. Boven Digoel election commission as Respondent assessed the Court had no jurisdiction over regent-deputy regent candidate pair Yusak Yaluwo-Yakob Waremba’s lawsuit.
“The Constitutional Court has no jurisdiction because the Applicant didn’t not the correct vote result (considered correct by the Applicant, ed.). In the lawsuit, the Applicant concerned on election stage and violations that committed by other parties,” explained Respondent’s Attorney Paskalis.
The election commission also denied Applicant’s argument saying the Applicant had passed candidate verification as stipulated in Boven Digoel Election Commission Decree Number 27/Kpts/KPU/BD/XI/2015 regarding regional election candidates. Therefore, the Respondent argued the Applicant had no legal standing because the Applicant didn’t consider as candidate. “The Applicant has no legal standing because they doesn’t consider as candidate pair. Applicant’s argument saying they has passed candidate verification, is incorrect,” said him.
Vote Margin more than 12%
Meanwhile, Ogan Ilir election commission denied entire Helmy Yahya-Muchendi Mahzareki’s argument. The election commission as Respondent assessed Applicant’s lawsuit was based on mere assumption and didn’t note vote result. Moreover, the Applicant had no legal standing due to the 12% vote margin, added the Respondent. “Vote margin between the Applicant with the Related Party (the winning candidate, ed.) is 12 % which more than 1.5% determined margin. Due to it, the Applicant has no legal standing,” said him.
Sekadau election commission assessed Applicant’s lawsuit was passed the deadline 3x24 hours. As known, the election commission as Respondent had determined recapitulation at 15.33 West Indonesian Time in December 16, 2015.
“Whereas the Applicant filed lawsuit to the Constitutional Court at 22.58 WIB in December 22, 2015, therefore it already passed the deadline as much as 79 hours 25 minutes,” explained Respondent’s Attorney Mehbob representing the election commission. (Lulu Anjarsari/lul/Prasetyo Adi N)
