Polling station working committee members destructed ballot boxes in Lintabuo district, Tanah Datar regent-deputy regent candidate pair Edi Arman-Taufiq Idris argued in election dispute preliminary session, on Monday (11/1), in Panel Session Room 1, the Constitutional Court Building.
Representing by Applicant’s Attorney Arsil Salim, the Applicant assessed their vote had reduced due to Tanah Datar election commission partiality which sided to candidate pair number 1 Irdinansyah Tarmizi-Zuldafri Darma. The Applicant also assessed the election monitoring committee sided with the Related Party because the committee considered ignored election violation report.
“The election commission, the election monitoring body and the election monitoring committee were sided with candidate pair number 1. As known, candidate pair number 1 is incumbent; the regent candidate is from regional legislative council, while the deputy regent candidate was former deputy regent,” explained Salim.
Responding the lawsuit, Constitutional Justice Manahan MP Sitompul questioned the lack of lawsuit demands in lawsuit revision. Sitompul said that the Applicant had noted petition demands in the original lawsuit which registered to the Court in December 19, 2015. “However, after revised in December 27, there is no petitum in the lawsuit,” said him.
Vote Reduction in Musi Rawas
Meanwhile, Musi Rawas regent-deputy regent candidate pair Ratna Machmud-M.Zabur Nawawi claimed they had lost 5437 votes in two districts, as much as 2682 votes in Tiang Pumpung Kepungut district and 2755 votes in Muara Beliti districts. “We felt discrimination which done by election commission in recount process in Muara Beliti and Tiang Pumpung Kepungut districts,” said Applicant’s Attorney Nasrullah Nawawi representing the Applicant of Case Number 113/PHP.BUP-XIV/2016.
Moreover, the Applicant also claimed there was money politics practice occurred in Batugane village. However, the Applicant didn’t report such issue to integrated law enforcer unit Gakkumdu. Chief Justice then said that such issue should be processed to Gakkumdu. “It should be reported to Gakkumdu who authorized to handle that (money politics, ed.). We have no jurisdiction over such case,” said Hidayat.
Justice Panel 1 also examined West Kalimantan election disputes; Ketapang regent-deputy regent candidate pair Andi Djamiruddin-Chanisius Kuan’s lawsuit (145/PHP.BUP-XIV/2016) and Kapuas Hulu regent-deputy regent candidate pair Fransiskus Diaan-Andi Aswad’s lawsuit (132/PHP.BUP-XIV/2016).
