Nabire Election Commission committed fraud by siding with regent-deputy regent candidate pair number 1 Isaias Dauw-Amirullah Hasyim, three Nabire candidate pairs Zonggonau-Isak Mandosir, Yakob Panus Jingga-Melki Sedek Fi Rumawi, and Decky Kyame-Adauktus Takerubun delivered in election dispute preliminary session on Thursday (7/1) in Panel Session Room 1, the Constitutional Court Building.
They argued the election commission had randomly determined permanent voter list, didn’t deliver voting invitation and made fictitious polling station. Applicant’s Attorney Jan Sulwan explained that some voting invitations (C6-form) didn’t delivered by the election commission. “Some voting invitations weren’t delivered,” said the attorney of candidate pair Zonggonau-Isak.
In response to Sulwan’s testimony, Panel Head Arief Hidayat questioned whether the Applicant had reported the problem to regional election monitoring committee (panwas). “Have you reported the problem to election monitoring committee? How did you carry the report? By written or oral?” asked Hidayat.
Sulwan said his party had reported the problem to Nabire election monitoring committee; however the committee considered there were no violations.
Blank C1 Form
Meanwhile, candidate pair Decky Kyame-Adauktus Takerubun explained the vote recapitulation was invalid because the BA-KWK form was inappropriate with C1 forms in Dipa and Siriwo districts. After the vote recapitulation announced, some candidate pair’s witnesses were objected with the recapitulation.
“Dipa and Siriwo election committee heads had announced valid recapitulation, which based on the BA-KWK original hologram. However, candidate pairs and the (Nabire, ed.) election commission were objected with the recapitulation, because they didn’t announce in accordance with C-1 form hologram,” said Aris.
When requested to announce the recapitulation based on C-1 form, the election heads argued the C1-forms, which were blank, had been forcibly taken by local police. “The blank C1-KWK forms had been forcibly taken by local police in Dipa and Siriwo district. The forms then returned by the police It already filled, which not based on both districts’ valid result,” explained him.
Panel Head Arief Hidayat then questioned the supposed number of vote result. According to the Applicant, candidate pair number 1 supposed to get 56.607 votes, while the Applicant supposed to get 59.549 votes.
Other candidate pair Yakob Panus Jingga-Melki Sedek Fi Rumawi argued candidate pair number 1 Isaias Douw-Amirullah Hasyim committed vote transaction. Applicant’s Attorney Saul Ayomi explained that the Applicant had attached recorded evidence regarding the vote transaction in the lawsuit.
