Law students of Universitas Sultan Ageng Tirtayasa Banten visited the Court on Tuesday afternoon (17/11). Court’s researcher Nallom Kurniawan welcomed their visit.

“Reading the Constitution is like reading beautiful text. Prior to the amendment, the 1945 Constitution has regulated citizen’s rights, however there is no legal ways to review acts if the acts considered violated the Constitution,” said Nallom to 218 law students.  

Recently, Nallom added, citizens could file objection towards acts if the acts considered violated their constitutional rights. “Imagine, act norms, which made by 560 legisators, can be annulled by judicial review. Indonesian citizens are more powerful after the Amendment,” said Nallom.

“Understanding constitutional rights is important. After you study law in university, you may practice it and file judicial review to the Court. Several law student forums have already file judicial review,” Nallom added.

The Amendment, Nallom added, resulted in equality of state institutions. “The Court has jurisdiction over state institution disputes,” said Nallom.

The Constitutional Court also has jurisdiction over political party dissolution. In this case, the Court corrected inappropriate constitutional practices in the past; President ordered for political party dissolution.

“At that time, President had huge authority. Will such practice continue to be done? Absolutely not. Consistent with law state principles, political party dissolution shall be done through legal ways. President is not allowed to arbitrarily dissolute political party,” Nallom asserted.

Similar with political party dissolution, Nallom also explained that the Court has jurisdictions over election dispute settlement and president impeachment. Nallom said that president impeachment should be done through legal ways in order to bring political stability.

“If President easily impeached, it will cause wide impacts. Political stability affects various sectors, including economy sector. The most detrimental sector which impacted with political instability is people,” said Nallom. (Nano Tresna Arfana/IR/Prasetyo Adi N)
