Chief Justice Arief Hidayat received in audience regional election monitoring coalition Koalisi Kawal Pilkada consisting of the Society for Election and Democracy (Perludem), the Election House (Rumah Pemilu), and the Initiative Code (Kode Inisiatif) on Thursday (15/10) in 15th floor Delegation Room, the Constitutional Court Building. The audience aimed to obtain understanding on single candidate dispute settlement.

“We came here to discuss Constitutional Court verdict which ruling single candidate in regional election. How the legal standing exists in single candidate dispute settlement?” said Perludem deputy director Veri Junaedi representing the coalition.

Junaedi then suggested that legal standing in single candidate dispute settlement could enabled to individuals, community groups, election monitoring body Bawaslu, or political parties. “If single candidate wins, the Bawaslu as election organizer may file dispute lawsuit to the Constitutional Court by giving testimony. Political parties, individuals, and community groups also have legal standing in single candidate dispute settlement,” he suggested.  

Chief Justice Arief Hidayat expressed his enthusiasm to coalition activities in monitoring election. Moreover, he said that all voters had to vote even though there was only single candidate participated in elections. “All voters still have to vote even though election is only participated by single candidate. Single candidate election is allowed in order to prevent election delay. Election delay is only allowed if people want to do so,” said Hidayat.

Responding coalition suggestion, Hidayat agreed that legal standing should be regulated in regional election dispute settlement. He also said that the Court had provided limitation on dispute lawsuit filing regulation. Recently, he added, the Court was formulating Constitutional Court Regulation regarding single candidate dispute settlement.

“We hope the regulation will be done in this week and immediately socialized to entire related parties. As known, the Court already held technical guidance for involving parties in the Court’s Pancasila and Constitution Center in Cisarua, Bogor,” said Hidayat.   

Before closing his speech, Hidayat hoped the coalition performed comprehensive monitoring in upcoming regional elections, in order to implement democratic elections. (Panji Erawan/IR/Prasetyo Adi N)
