The Constitutional Court (Mahkamah Konstitusi –MK) declares grant judicial review petition on Act Number 17 Year 2014 of Legislative Institutions (Undang-Undang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah,dan Dewan Perwakilan Rakyat Daerah –UU MD3). As known, the Regional Representative Council files the petition on Act a quo, which registered in Case Number 79/PUU-XII/2014.
“Judicial verdict declares grant Applicant’s petition in its partially,” said Chief Justice Arief Hidayat when read Court Verdict.
The Court assesses Applicant’s petition regarding DPD’s authorities in drafting law which related to region autonomy, central-local relations, autonomy region establishment, nature resources and other economical resources management, and central and local financial balance, has legal ground and in accordance with Constitutional Court Verdict Number 92/PUU-X/2012 dated March 27, 2013.
The Court says the DPD may submit academic papers to House of Representatives chairman and the President. Unfortunately, the legislator of Act a quo is indeed doesn’t attach the Court Verdict aforementioned, so the DPD again sues the provision regarding DPD’s participation in drafting law.
In the other side, Chief Justice Arief Hidayat and Constitutional Justice Maria Farida Indrati give different opinion, in which both state that Applicant’s petition shall be granted entirely. (Panji Erawan/Prasetyo Adi N)
