The Court Holds Whistleblowing System Socialization

The Constitutional Court (Mahkamah Konstitusi –MK) holds whistleblowing system socialization in matter of goods and services procurement for Court’s Registrar and General Secretariat staffs on Wednesday (2/9), at Ground Floor Hall, Constitutional Court Building. The Court presents the Government Procurement of Goods and Services Agency (Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah –LKPP) as keynote speaker.

Opening socialization event, Court’s Secretary General Muhammad Guntur Hamzah delivers the importance of whistleblowing system as an attempt to prevent abuse. He reminds court staffs to always conduct their tasks with good intention.

“I declare I will not do abusive things. I hope entire staffs in Court’s Registrar and General Secretariat give input to their leader to avoid mistakes which later could be regarded as abuse,” said him.

Guntur explains whistleblowing system will accommodate entire report regarding goods and services procurement abuse via application, so entire staffs could report the abuse with no fear. Whistleblowing system application could keep Court activities in the right track so court staffs able to complete their works with no anxiety.

The application is accessible through Court official website www.mahkamahkonstitusi.go.id. Whistleblowers shall attach their identity in order to prevent libel. “Please prevent spams in our application. If the information entered the application is false information, it will hurt the person accused,” added him.

Meanwhile, LKPP’s Director of Legal Issues Management (Direktur Penanganan Permasalahan Hukum) R. Fendy Dharma Saputra says goods and services procurement is still on the top three corruption cases. Based on Corruption Eradication Commission (Komisi Pemberantasan Korupsi –KPK) data, there are 9 procurement cases of 70 corruption cases in 2013. The percentage of procurement cases is increased in 2014; 15 cases of 58 total corruption cases.

Fendy says whistleblowing system is one of the attempts to reduce procurement corruption index. The legal basis of whistleblowing system is the ratification of United Nation Convention Against Corruption Year 2003 through Act Number 7 Year 2006, Presidential Regulation Number 55/2012 of National Strategy for Prevention and Eradicating Corruption in Long Term Year 2010-2025 and in Medium Term 2010-2014. The legal basis of whistleblowing system also stipulated in Article 116 (2), (3), (4) Presidential Regulation Number 70/2012 of Government Goods and Services Procurement.

Moreover, he explains whistleblowing system is developed as concern on whistleblowers that are not eager to report by general report mechanism. Fendy also says that the system is created for report internal affairs because internal staffs are the person who knows exactly on the data and information regarding the abuse.

He further says whistleblowing system is intended to improve corruption eradication attempt in matter of goods and services procurement, support procurement abuse report, and improve supervision system which provide protection to whistleblowers. (Lulu Hanifah/IR/Prasetyo Adi N)
