The Constitutional Court (Mahkamah Konstitusi –MK) decides judicial review petition on Act Number 2 Year 2014 of Act Amendment Number 30 Year 2004 of Notary (Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris –UU Jabatan Notaris) inadmissible. Advocate Tomson Situmeang files the petition. Chief Justice Arief Hidayat reads the verdict at verdict announcement session, on Wednesday (26/8), at Plenary Room, the Constitutional Court Building.
“Court verdict adjudicates declare Applicant’s petition inadmissible,” said Arief when read court verdict on Case Number 72/PUU-XII/2014.
The Court assesses the Applicant has neither concrete constitutional loss nor potential constitutional loss by the enactment of Articles reviewed. According to the Court, Applicant’s rights have indeed guaranteed and protected by the existence of the Notary Honorary Council (Majelis Kehormatan Notaris –MKN) when there is a request for evidence in form of minuta deed copy (fotokopi minuta akta) or notarial deed copy (fotokopi akta notaries). The Court further says, the Applicant may be as notary’s attorney in order to protect notary who deals with legal issue and use Articles reviewed as legal umbrella.
Regarding Applicant’s legal standing as taxpayer, the Court cannot ensure whether or not the Applicant suffers lost by the enactment of Articles reviewed. Therefore, the Court concludes the Applicant has not legal standing to file the petition. Thus, the Court doesn’t consider Applicant’s petition points (pokok permohonan).
Previously, the Applicant reviews Article 66 (1), (3), and (4) Act of Notary which regulate the mandatory of Notary Honorary Council’s approval towards notary who examined in legal process.
Article 66 (1) Act of Notary stated:
For the sake of justice and with the approval of Notary Honorary Council, investigators, prosecutors, of Justices are entitled to: (Untuk kepentingan proses peradilan, penyidik, penuntut umum, atau hakim dengan persetujuan Majelis Kehormatan Notaris berwenang:)
a. take Minuta Deed copy and/or letters attached to Minuta Deed or Notary Protocol which kept by Notary; and (mengambil fotokopi Minuta Akta dan/atau surat-surat yang dilekatkan pada Minuta Akta atau Protokol Notaris dalam penyimpanan Notaris; dan)
b. summon Notary in examination which related to Deed or Notary Protocol which kept by Notary. (memanggil Notaris untuk hadir dalam pemeriksaan yang berkaitan dengan Akta atau Protokol Notaris yang berada dalam penyimpanan Notaris.)
The Applicant considers detrimental by the phrase ‘with the approval of Notary Honorary Council’ (‘dengan persetujuan Majelis Kehormatan Notaris’) in Article 66 (1), Article 66 (3), and Article 66 (4) Act a quo. According to the Applicant, such provision cause integrity loss in legal services which involving advocates, so the reputation of legal services might be degenerated and decrease public trust.
The Applicant is often dealing with opponent party during judicial stages regarding his authority to take Minuta Deed copy and/or letters attached in Minuta Deed or Notary Protocol which kept by notary and to summon Notary in examination which related to Deed or Notary Protocol which kept by notary. Thus, the Applicant considers he entitled to get fair legal certainty in the matter of Notary Honorary Council’s authority. (Ilham WM/IR/Prasetyo Adi N)
