Karimun Regent for 2010-2015 terms Nurdin Basirun revises his petition on Act Number 8 Year 2015 (Act of Regional Elections). Representing by Applicant’s Attorney Andi Muhammad Asrun, the Applicant said he had done petition revision as advised by Justice Panel on the previous session. One of the revisions is sharpening petition arguments.
Asrun redelivers his constitutional losses which caused by the provision in Article 1 number 6 of Amendment on Article 7 letter o and letter p Act of Regional Elections. The Article a quo requires deputy regional head candidates to have yet served as governor, regent, and mayor; and to resign from their position as Governor, Deputy Governor, Regent, Vice Regent, Mayor, and Deputy Mayor for candidates who run candidacy in other regions since determined as candidates.
“Why should candidates required to resign if run candidacy in other regions? There is no relation with regional head position,” affirmed Asrun in front of Justice Panel led by Constitutional Justice Manahan MP Sitompul, on Thursday (30/7).
Asrun argues the development on respective region will be inhibited if the incumbent resigned. Further, the drafting of new Regional Budget (Anggaran Pendapatan Belanja Daerah –APBD) will be conducted on next December. “That is the most concrete of Applicant’s loss,” Asrun added.
The Applicant also revises on petition petitum. As known, his petition registered in Case No. 83/PUU-XIII/2015.
Responding the revision, Manahan MP Sitompul as head panel of the session informs similar judicial review on Article 7 letter o Act a quo which filed by Applicant of Case Number 80/PUU-XIII/2015. Therefore, the Panel will inform the proceedings of both cases to each respective Applicant.
“The proceedings will be linked with the Case Number 80 and later it will be inform to each respective Applicant,” explained Manahan who also ratified eight evidences filed by the Applicant on this session. (Yusti Nurul Agustin/Prasetyo Adi N)
