The Constitutional Court (Mahkamah Konstitusi –MK) granted withdrawal of judicial review petition on Act Number 8 Year 1981 of Criminal Procedure (Kitab Undang-Undang Hukum Acara Pidana –KUHAP) on Tuesday (26/5) at Plenary Room, the Constitutional Court Building. The case listed in Number 44/PUU/XIII/2015 was filed by Damian Agatha Yuvens, et al. who reviewed pretrial provision as stipulated in Article 1 number 10 letter a and Article 77 letter a Act a quo. The Justices’ Consultative Meeting had determined the withdrawal had legal grounds.
“Grants withdrawal of Applicant’s petition,” declared Chief Justice Arief Hidayat at Plenary Room, the Constitutional Court Building.
Based on the Meeting, the Applicant cannot re-file judicial review on Article 1 number 10 letter a and Article 77 letter a Act a quo.
Previously, the Applicant delivered the petition withdrawal at the session held on Monday (4/5). Representing other Applicants, Luthfie stated to withdraw the petition.
“The Panel, we hereby Applicant III, Applicant IV, and Applicant V who present in this room representing Applicant I and Applicant II, hereby file for repeal on judicial review on Act No. 8 Year 1981 on Criminal Procedure towards the 1945 Constitution, in Case Number 44 / PUU-XIII / 2015, on this day May 4, 2015," said Luthfie in front of Justice Panel led by Constitutional Justice Suhartoyo at that time.
The reason for petition withdrawal was because the Court had issued a verdict for similar petition. (Triya IR/Prasetyo Adi N)
