Chief Justice Arief Hidayat felt worried of law manifestation in Indonesia. “Law manifestation in Indonesia could not run as it is supposed to be. What is wrong, then? Is it the human resources? Human resources of law is formed by law faculty of universities,” said Arief when became keynote speaker at National Panel Discussion entitled “Quality Improvement of Law Education in Globalization Era” (“Peningkatan Kualitas Pendidikan Hukum Indonesia di Era Globalisasi”) which held by Universitas Tarumanegara on Wednesday afternoon (20/5) in Jakarta.
Whereas, Arief added, the conception of law in Indonesia based on the Constitution was better than law manifestation of other countries, either in the common law system, civil law system, or in other system.
“Law in Indonesia is law based on the values of Belief in One Almighty God (Ketuhanan Yang Maha Esa). The conception of Indonesia is religious welfare state,” said Arief.
“For example in Supreme Court verdicts, Constitutional Court verdicts, judiciary, law establishment, all of those are based on blessing for the grace of Almighty God,” said Arief.
Therefore, Arief revealed, law should be implemented under influence and foundation of God values. However, law in Indonesia was unable to provide inner and outer prosperity. “We can see that there are several cases of bribery committed by judge, bribery received by judge, and so on,” said Arief.
“So, one-third of judges in Indonesia go to heaven, one-third go to hell, where another one-third of judges go? Hell didn’t want to receive, eventually they go into trees and channels,” Arief joked.
Arief argued, suspect naming should be delivered wisely. “But in fact, suspect naming conducted by heroically. It seems arrogant and it doesn’t base on God affection,” Arief wisely added.
In addition, Arief highlighted on legislation process which based on personal benefit, rather than based on proper values. “Law in Indonesia is very outstanding. How come the justice based on Belief in God becomes transactional?” Arief concerned.
Moreover, Arief defined law into two things, law formulation and law implementation. “Implementing law is including on law enforcing,” said Arief. (Nano Tresna Arfana/Prasetyo Adi N)
