Expert: Electrical Devices Must Fulfill Standard

Electrical engineering expert and National Power Council member Tumiran told that installed electricity device must be fulfilling technical standard and proven through certified technical test in order to avoid electrical disruption for the consumer. “For instance, due to electrical cause a building caught in fire, the current must be cut, or else it would harm other consumers,” he said in proceeding trial Act 30/2009 about Electricity at MK Plenary Room, Jakarta, Thursday (12/11).   

Moreover, standardized electricity device will safeguard consumers from fatal implication. Other than that, installation also must protect devices.

Therefore, the standard is not just implemented but also installed by competent institution. “Electric installation, before being overflowed by the current must be checked to its standard whether or not it has fulfilled the requirement,” said Tumiran who was presented as Government’s expert.

“Your Majesty, to harness electricity, it is required proper electric installation, standardized, and being done by competent side so that the installation is safe enough to be utilized,” he added.

Meanwhile, Isa Adris, a witness who was presented by related parties, told his experience when installing Operation Feasibility Certificate (SLO) certified electricity devices.

His to-be-overflowed new house was visited by electricity-checking team. “I know nothing about their authorization. By the time being, they came up to tell they are from PPILN. I was told that the electric installation must be checked first,” he said.  

“Plugs, switches, cables, were all being measured. After some days, I received the certificate (SLO),” he added.  

Isa said, the checking charge is included in installment cost by the Electrical Engineer Bureau (BTL),”All the cost for installment and certificate is around 1,7 million rupiahs,” he explained.

Article 44 verse (4) Act 30/2009 about Electricity determined the usage Operational Feasible Certification (SLO) for PLN new and power upgrading consumers is filed by Ibnu Kholdun. The regulation is seen to hurt consumers.

he described that Article 44 verse (4) and Article 54 of the mentioned Act are hindering. “According to the factual situation, their houses are not worth more than a hundred millions, but the fine applied five folds. This means that the article is forcing, restricting,” he said.

According to the Plaintiff, the settlement opposed Article 28 letter g of 1945 Constitution. “According to 1945 Constitution we are free to do anything in order to protect their interest. The article is forceful and malfunction,” he said.

Article 44 verse (4) Act of Electricity says:

Every operating electricity installation has to have Operational Feasible Certificate   

Article 54 of Electricity Act says:

(1)   Every person who operates electricity installation without Operational Feasible Certificate as determined in Article 44 verse (4) is subject to, at longest, 5 years of imprisonment and highest fine off Rp 500,000,000,00 (Five Hundred Million Rupiahs)    

(2)   Every person who produces, publishes, and trades electricity tools utility to match Indonesian national standard as Article 44 verse (5) determined, will be imprisoned for, at longest, five years and fined, at most, Rp 5,000,000,000.

Therefore, the Applicant asks MK to abolish Article 44 verse (4) and Article 54 Electricity Act and declared the usage of SLO is not an obligation. (Lulu Hanifah/kun)
