Hamdan Zoelva: MK Balances Democracy and Law Enforcement

Taking place at Embassy of RI in Moscow, Chief Justice Hamdan Zoelva held meeting with Indonesians who resides in the ex-Soviet Union federal state. The meeting was held on Saturday (11/15). Hundreds of Indonesians attended the meeting.  

Aside from Indonesia citizens, several attendants were noted as Russian students who major about Indonesian culture and history.   

HE Djauhari Oratmangun, RI Ambassador to Russia and Belarus, expressed his joy and gratitude for the visit. He said that meeting is part of visit series after on November 13, MoC between the MKRI and its Russia’s counterpart being signed in Saint Petersburg.   

Performance from Indonesian Elementary Students Choir started the meeting. Aside from Indonesia Raya, the classic “Rayuan Pulau Kelapa” (Solace on Palm Island) was also chanted by the students in bilingual, Indonesian and Russian. The performance spurred round of applause from the attendants.  

MKRI’s competences

As determined in the Constitution, Hamdan Zoelva cited that MKRI possess 4 authorities and one obligation. Constitutional Court has the authority to hear at the first and last decision is final for, (1) Testing the law of the National Policy Law of Republic of Indonesia Year 1945; (2) Resolving the authority disputes of state institutions whose authorities are granted by the 1945 Constitution; (3) Decide upon the dissolution of political parties, and; (4) Decide disputes concerning the election results.

While the obligation is, Constitutional Court shall pass a decision on the opinion of DPR that the President and / or Vice President of suspected

If being related to law and democracy development in Indonesia, according to Hamdan Zoelva, the implementation of which completes democracy transition and carves milestones of democracy consolidation. Judicial review mechanism flaunts the effort of guaranteeing people’s rights aligning values confined in the Constitution.

In the context, Act must adhere the Constitution as the supreme law of the land which has set constitutional bonds against all the arbitrary Acts. In its efforts all along, MK has issued many verdicts with strong basis in erecting political development and law enforcement.  

Therefore, according to Hamdan Zolva, Constitutional Court deserves to be dubbed as significant politics fixer, given its role in guarding democracy and protecting people’s sovereignty. (FLS/kun)
