Jakarta and East Nusa Tenggara Provincial Legislative Council (DPRD) members, pleaded for composition and mechanism of  DPRD memberships as determined in UU MD3. The preliminary trial was held on Wednesday (11/19) at MK Plenary Room. Muhammad Syakur Mandar and Ramdan Alamsyah, acted as Plaintiffs’ attorney.   

The trial began as Muhammad Syukur cited that rule has harmed Plaintiffs’ constitutional rights. Article 327 verse (2) UU MD3 says that DPRD Speakership must be chosen from the winning party. The ruling allegedly leads the winning party to occupy DPRD speakerships automatically. “Such thing doesn’t happen to DPR Speakership, albeit two institutions are legislative instruments,” Muhammad Syukur said comparing to DPR Speakership.

Besides, the ruling was deemed failed in accommodating their legal interest. It hindered them to take Speakership chair. It is happened as which article adjudicates so.

“By such adjudication […] there is no way speakership in DPRD is to be fulfilled on merit-based assessment. At the same time, it demolishes democracy mechanism as adhered by DPR members.” Muhammad Syukur said.

In other words, Muhammas Syukur explained that if the provision continued, DPRD Speakership is predominated by winning parties. It condemned competition impression and is contrary to the speakership regulation in DPR.   

Such different mechanism has sparked legal certainty, according to M Syukur. “The provision has elaborated double standard and sparked unparallel law, it is discrimination in democracy,” Muhammad Syukur said.

Additional DPRD Speakership

Meanwhile, Ramdan Alamsyah who is also Jakarta DPRD member hinted that Article 327 verse (1) letter a is ambiguous. Whereas, the Plaintiffs are eligible to gain equal treat, in the name of justice.   

The Article was also deemed failed to accommodate hundred members of DPRD. According to Ramdan, increasing member must be accompanied by the speakership addition.

“According to the Plaintiffs, adding one more deputy speaker is applauded to deal with increasing number of the DPRD members,” Ramdan said. (Yusti Nurul Agustin/kun)
