MK Welcomed Surya Kencana Students

Constitutional Court received visit from Students of Surya Kencana University, Cianjur on Thursday (11/20). Taking place at MK hall, he visit was openhandedly welcomed by Constitutional Justice, Maria Farida Indrati.     

Amidst her bustling agenda, the Justice, who is also considered as the Indonesia’s best State Administration expert taking chance to welcome the students.

“I choose to be here (welcoming the students), you’ve come from far, I can’t just leave,” Maria said sparking applause from the Students.

In the given chance, Maria explained that MK’s decision is final and binding and it is level to the replaced Act. “The decision come into effect after the hammer being knocked, no need to wait for Act replacement. Some might think that, bu that is not true. inefficiency by time and implementation,” Maria said.

Aside from describing the mechanism, principle, and procedure in MK. In the meeting, the first Woman Constitutional Justice also opened discussion session. Enthusiasm was seen from swarming questions. A Student asked guarding MK’s independency.  

Maria explained that the duty was taken by Ethical Council which consists of Former Justice, Legal Expert, and neutral. “Recently, they take care effectively to fence MK from derailing and maintaining MK’s integrity, by no other mean but to keeping public’s trust,” Maria said.

Dissolving Political Party

Party dissolution and impeachment are two things that haven’t been accomplished by the Court, complex procedures are abundant before MK can decide in such serious matter. A student, named Gilang asked about the procedure of Party Dissolution. “Why when a party packed with corrupters, no one contend its dissolution?” Gilang asked.

In response to that, Maria suggested that this is not as easy as it heard. “The one who owns the legal standing for party dissolution is the Government, it has to be completed with explanation of ideology, principle, goals, and program to which allegedly violating the Constitution. Should such procedures are to be founded, Ministry of Law and Human Rights may just repel them from the first place,” Maria said.  

“Corruption usually done by individual, albeit it may be done for the party’s interest. But it cannot be adjudicated to be the basis in dissolving party. It should be sentenced personally not the entire party,” she added.

MK has routinely welcomed visit from several institutions. The visit was somehow considered fruitful from the visiting side. One of the Surya Kencana Students, Shinta expressed her pleasure to visit MK. “This visit really helps me to know more about MK, through that explanation, I do believe MK may maintain its integrity for the good of our people,” she said.  (Winandriyo Kun)
