PRC Deputy Chief Supreme Justice Paid a Visit to MKRI

Deputy Chief Justice of the People\'s Republic of China (PRC) Supreme Court Shen Deyong, conducted a courtesy visit with Chief Justice Hamdan Zoelva, at MK Building Indonesia, Thursday (6/11), accompanied by a number of judges and representatives of the Chinese Embassy.

Shen Deyong said, the purpose of his visit to the Constitutional Court (MKRI) is to learn more about the Indonesian judicial system and strengthen the relationship between the PRC Supreme Court and MKRI. Shen Deyong revealed that its presence as well as to look for references and learn from Indonesia on the reform of the court, because PRC is currently undertaking series of improvement in order reform its judiciary system.

In response to that Hamdan explained that Indonesia had two highest judicial bodies, the Supreme Court and the Constitutional Court with different authorities. It was explained, the Supreme Court has the authority to hear cases such common crime, civil, and administrative, including testing of all regulations under the Act (the Act). While the Court has the authority to conduct a judicial review of the Constitution, then adjudicate disputes between state agencies whose authority was granted by the Constitution, to decide disputes the results of elections, to dissolve political parties, and to decide the House of Representatives’ proposal regarding the opinion of impeachment against the president.

Furthermore Hamdan explained, at its eleven years of establishment, the Court has conducted a judicial review of the Constitution and own a very broad impact on law enforcement in Indonesia. Similarly, in dealing with the results of the legislative election disputes (pileg) and presidential elections (pilpres) in 2004, 2009 and the last in 2014, the Court had to decide over election disputes well and the result were respected by all the people of Indonesia.

Hamdan said, according to the Constitution, MKRI can declare a law made by the Parliament and the President is contrary to the constitution. "Therefore, the position of the Constitutional Court isvery important in law enforcement in Indonesia," said the former member of the ad hoc Committee of the Assembly I who was involved in the brewing of constitutional amendments.

In the occasion Hamdan asked Deyong regarding the judicial system in China. According Deyong, China has a notch in the Constitution as the supreme law. Although China does not have such Constitutional Court, but the completion of the implementation issues in China\'s constitution has been the domain authority of the National People\'s Congress in which Standing Committee of the National People Congress own the authority to resolve the problems of the Constitution implementation.

Deyong explained in the judicial system in China, Supreme Court has a top notch, overshadowing High People\'s Court that is located in every province, Intermediate People\'s Court which is located in the provincial capital and Basic People\'s Court that is located in the district or special autonomy region. In addition, the Supreme Court of China also has a special court, among others, the military court, maritime court, "Even in the past, we also had a special Train Court." Said Deyong.

 

During the meeting, Hamdan Zoelva and Shen Deyong both appreciated each other and expressed gratitude for a description of the court system of each country. (Ilham/mh/kun)
