Demand to clarify 5 villages’ status in Nias as petitioned by Nias DPRD member was snubbed. Constitutional Court decided to refuse the judicial review on West Nias Formation Act. The petition was filed by Wa’ onaso Waruwu, Aluizaro, and Ronal Zai.

In the 26-page thick verdict, the rejection was due to their failure in representing regional’s interest along with the regional executive and DPRD’s permit. Besides, the Court failed to find any factual and potential loss that the Plaintiff might have encountered.

Expansion of the district of Nias into West Nias the coverage territory taken from one of the district located in the main district of Nias, District Lolofitu Moi which comprises thirteen villages, is a logical consequence of the expansion of an area that is still within the scope of the Republic of Indonesia . If the preparing the budget for its own territory, should no longer question the village budget has become another area coverage, in this case the village has entered the coverage area of West Nias and it can also be consulted directly to the central Government in this case, through the Home Ministry so it will not harm the Petitioners as the local government.
