Pancasila is the source of norms in Indonesia. As a moral basis, Pancasila comprised epistemology and axiology ground where the justification of each point lies on.

The statement was delivered by Justice Patrialis Akbar in Public Lecture in Perbanas Institute Jakarta, Friday (10/31). In the lecture, entitled “Pancasila in Preventing Corruption and Constitutional Court’s Role in Democratic State,” Patrialis addressed that Constitution Preamble situated Pancasila as state’s philosophy foundation. Due to its role, Pancasila must be the fundamental norms for the state in extending protection, welfare, education, and contributing for the world’s peace.

Apart from it, MK has always been positioned in guarding the Constitution. Within its authority, MK takes role in protecting constitutional and Human Rights. “The Court is part of the Judicial authority whose role comprises law enforcement and guarding the Constitution as determined in 1945 Constitution and Act 8/2011,” Patrialis said.

Before closing his speech, Patrialis said that in Indonesia democratic system, MK plays a role to utilize software and brainware adjustment. Software measurement is related to official rotation, development of institution in democratic nation, reform of work mechanism, and progression to democracy.

Meanwhile. Brainware is related to progressive law enforcement, tackling conservative notion and everything that hampers democracy. “The existence of Constitutional Court is the consequence of guaranteeing Moderne Democratische Rechsstaat and strengthening Modern Constitutional Democracy. The formation of MK is expected to process better state administration,” he said.
