Constitutional Court (MK) declared to refuse 5 petitions concerning judicial review on Act 22/2004 (UU Pilkada). The decision was recited by Chief Justice Hamdan Zoelva on Thursday (10/23) at MK Plenary Room.
According to the Court, President has issued lieu of law (Perppu) 1/2014, in which annul UU pilkada by the time the lieu of law being issued.
Aside from it, on Monday (10/13), The Court has held a hearing in which the Court gave two options about the validation of pilkada lieu of law. “The Court gave two options whether or not to revoke the petitions, as the object has been removed. The Plaintiff opted to give it on our call,” Hamdan said.
Hamdan described that the Plaintiffs cannot appeal for judicial review on UU pilkada anymore. “Instructing the Clerk to issue Petition Revocation Deed and redeem the document to the Plaintiff,” he said.
The decision finally ended the frenzy Pilkada issue. Regarded declining democracy norms, Constitutional Court was once hoped to annul the Red-and-White Coalition’s product. However, by the issuance of the lieu of law, the law is now under scrutiny. The Act itself is expected to be annulled completely after the lieu of law gained majority vote in the parliament.
