Constitutional Court (MK) held another revision trial of judicial review on Act 5/2004 about Supreme Court. The Plaintiff, Dwi Hertanty, represented by Robert Paruhum. Panel consists of Muhammad Alim, Arief Hidayat, and Wahiduddin Adams. “You may delivered the point of your petition in short, which part has been revised,” Muhammad Alim said.
“We have added Act 8/2011, as well as Act 3/2009. For the preambule, six-page ontro has been decapitated into just two pages,” Robert said.
Article 28D verse (1) and Article 28I have been used as pole. Petituum is getting perfection as advised by the Panel.
“Plaintiff, we may deliver this to the plenum. our decision will be issued at anytime soon, you may just have to wait,” Alim said.
As known, the filed petition was coated in argument that the Plaintiff was sentenced for 2 months imprisonment due to the household abuse as determined in Article 44 verse (4) Act 23/2004.
According to the Plaintiff, the ruling has harmed his rights as such convicted may not apply for cassation . Another Article adjudicates that the regulation was meant to restrict lower-level Court decision in quality. However, the reason is considered harming Plaintiff’s Constitutional Rights because the phrase “tendency” is relative and not strong enough to regulate matters.(Nano Tresna Arfana/mh)
