Testimonial Hearing from Related Parties and Government Experts were held to deliberate judicial review on Act 8/2010 (UU TPPU) on Thursday (10/16) at MK Plenary room. PPATK, Anti Money Laundering Society, and Judicial Crime Reform Society attended the trial which led by Chief Justice Hamdan Zoelva.
Expert from the Government Arief Amrullah focused his testimony on Article 77 and 78 UU TPPU. According to him, the crime has organized and global-scale impact as its character, primarily because the fact that international finance system are now integrated. Indonesia, somehow must adopt international regulations concerning the issue.
“Considering the fact that it may lead to funding international crime, the completion can’t be done separately and must be conducted in common framework throughout the globe. The current of illegal funding has dispersed and spurs other form of crimes,” Arief said. “Based on those characters, tracing money must be executed to limit the broad-range current of money laundering,” he added.
Tracing back money is done due to glorify human rights. If one failed to explain his/her financial support, the failure may not put as evidence, instead the tracing is the one which later proved the crime. “Article 77 and 78 UU TPPU are clearly not trespassing the Constitution,” Arief said.
Meanwhile, Kokom Komariah, PPATK’s expert, said that doubt over phrase “Known or deservedly suspicious” in Article 2, 3, 4, 5, 69, 76, 77, 78, and 95 is not deserved a place. This case, primarily the convicted is state official, actually an easy regular basis to be decided. “He was caught red-handedly, original inventory is not necessarily needed,” Kokom retained.
Akil Mochtar, who acted as the applicant in this case was convicted of bribery Election Disputes in Gunung Mas with members of the House Chairun Nisa, Regent Gunung Mas Hambit Bintih and Entrepreneurs Cornelis Nalau. As for the case of bribery Election Disputes in Lebak, Akil Mochtar, Entrepreneur Tubagus Chaery Wiradana and an Advocate Susi Turandayani. Akil caught red-handed accepting a bribe during a search conducted on October 2, 2013 the Commission.
