Applicants of judicial review on Act 17/2014 (UU MD3) revised their pleading. Applicants, consisting of several NGOs have perpetuated their petition and revised their petitum.  

Nur Amalia, Applicants’ attorney, said that the form of her petition has been adjusted as determined in Constitutional Court Law 6/2005. Argumentation in posita has also been accentuated. “We perpetuate our argumentation basis to described 30-percent women’s representatives necessity,” She said at MK Plenary Room, Jakarta, Monday (10/13).

In petitum, Applicants also replaced word “accept” into “grant”. “Besides, we also have removed petitum number 19 to 21 because MK is not able to act as active legislature,” he added.

Lastly, the Applicants also removed their BAKN (State’s Financial Accountability Board)-related petition so the petition pulled up 30-percent representatives as subject. “However, BAKN is missed in Act 17/2014,” She said.

Indonesian Women Coalition for Justice and Democracy (KPI), Center of Women’s Political Development and APIK foundation are struggling for Women’s representative chair in DPR.

The Applicants called for Article 97 verse (2), Article 104 verse (2), Article 109 verse (2), Article 115 verse (2), Article 121 verse (2), Article 152 verse (2), and Article 158 verse (2) UU MD3. The already controversial and frenetic Act has been accused for removing all women’s rights especially when it comes to representing in chairs of house’s position. The Act, explicitly remains silent to Women’s representative threshold, presumably sparks less favor to the women. (Lulu Hanifah/kun)
