Constitutional Court declined a petition filed by 6 citizens for judicial review on cigarettes advertisement ban in Act 32/2002 about broadcasting Act. Chief Justice Hamdan Zoelva, recited the verdict on Thursday (10/9).  

 In the petition, Plaintiffs ask a judicial review on Article 46 verse (3) letter c as long as phrase “Shows cigarettes” and advertisement that “Cigarettes shown in cigarettes promotion”.

The Court opted that Article 46 verse (3) letter c broadcasting Act, never situates cigarette as prohibited product to be published, no ban also labeled to clove or tobacco, therefore cigarette is legal, prompted by custom applied to it.

 Accordin to the Court, although cigarette contained addictives, cigarette is still legal product to be advertised, so the Article 46 verse (3) letter c does not oppose Article 28D verse (1) 1945 Constituion.

Previously, six Plaintiffs advocated by Public Advocate Solidarity for Tobacco control (Sapta Indonesia) filed for judicial review on Article 46 verse (3) letter c. the Plaintiff objected that cigarette producers can promote their product in any way possible, and stimulate cigarette consumption.
