Students From Sebelas Maret University (UNS) paid a visit to Constitutional Court (MK), Wednesday (10/8). The visit was welcomed by Head of Cases Research and Information Technology Development (P4TIK), Guntur Hamzah.
“1945 Constitution is written, but there is also the unwritten one, live and dynamic. Constitution is more than just the written one,” Guntur said
Guntur said that Constitutional Court was formed after the third 1945 Constitution amendment, which took place in 2001.
“1998 resorted as the turning point, reform urged for 1945 Constitution amendment. As the student turmoil, amend toward 1945 Constitution might as well change our state administration,” Guntur explained.
“Especially related to Presidency, after the amendment President may only occupy the post in two terms,” Guntur added.
The case of Marburry v. Madison which took place in 1801 sparked an importance of Constutitional Court.
According to Guntur, who is also a Professor at Hasanuddin University, the case smeared dilemmatic circumstance, it put President John Adams’s and ongoing Thomas Jefferson’s reputation on stake.
William Marburry, was appointed to be Justice of Peace by President John Adam, while his presidential tenure is ending. Nonetheless, the commission was postponed by the new Secretary, James Madison. The case was later petitioned to Supreme Court which headed by John Marshall, a former Secretary under John Adam’s administration. Havoc turned to a year shutdown, preceding ultra petita decision that declined the petition in 1803.
In the opportunity, Guntur also described MK mandatory and competences. MK’s competences comprise, to decide over state institutions disputes, dissolving political party, decide over election disputes.
