Independency became main topic in another occasion related to Constitutional Court (MK). After the topic being spotlighted in worldwide Constitutional Court conference several weeks ago, the importance of independency being delivered once again as MKRI welcomed 50 students from Diponegoro University (Undip) in MK Hall, Tuesday (10/7).
Fajar Laksono, MKRI P4TIK researcher explained that independency takes important role in every occasion that any Constitutional Court in all over the world had encountered. “What happened in Mongolia and Ukraine, showed that independency is non-negotiable and crucial,” said Fajar referring to what happened in both countries, wherein political-based motive allegedly labeled to the Courts. The cases later prompted contention between power branches in both countries.
In the visit, Fajar also explained that three proposer institutions, DPR, MA and President can’t relate themselves to the Justices. By the time Justices pledged their oath, any political and interest relation to former institutions or proposers eventually broke.
According to him, IN the 11-year stands firm of MKRI, not even once its credibility never been breached by any intervention, neither from President nor DPR. It’s glorifying trust and awareness of regarding each role. “Independency can be measured by looking at MK’s verdict,” Fajar said. He also added that MK’s verdicts merely reflected the Constitution itself, constructing a stronghold to repel even the tiniest drop of the slickest intervention.
Accountability and Transparency
Accoding to Fajar, Independency can only take place if the execution of which involve the principle of Accountability and transparency. “MKRI will always be a modern and trusted Court. Everything can be accessed by public, anything you want to know you can find it on our website,” Fajar said.
Transparency and rights to know became MK’s main concern. Comprehensive website that MK provides, aligned with MK’s goals in shaping itself as IT-based modern institution. Thus, MK’s independency is not just something that shown up on the surface, but also utter and-yet visible.
Appreciation hinted by one of the students, “I see MK has given informative impression […] the description shows MK is serious in maintaining its independency,” Christy said
Visit to MKRI is part of series event conducted by Undip for its Law school students. Aside from MKRI, the students will also visit Supreme Court and Corruption Eradication Commission (KPK). (Winandriyo Kun/kun)
