Honorees Revised Petition of UU ASN Judicial Review

Proceeding trial of judicial review on Act 5/2014 about State Civil Apparatus (UU ASN) was held by Constitutional Court (MK) on Monday (10/6). The petition was filed by Indonesian Honoree Fighter Forum (FPHI).

In the second trial, the Plaintiff explained that revision has been done as advised by Panel of Justices. In accordance to legal standing, the Plaintiff split into two, Rahmadi Sularso as Civil Servant and other Plaintiffs as honorees.

“Some addition, why we use Act 13 (2003) is because the Permenkes (Health minister regulation) says that contracted workforce referred to Act 13/2003. We also pleaded about the non-existence of regulation determining PTUN’s role in workforce disputes,” he said   

In its lawsuit, The Applicant explained that its constitutional rights were harmed by the ruling of Article 67 Act 5/2014 about State Civil Apparatus (UU ASN). The Article says, “further regulation about civil servant recruitment and civil servants’ oath as determined in Article 58 to Article 66 regulated in President’s regulation”. The ruling was seen discriminative and harm the Applicant’s constitutional rights because no wage is guaranteed for honorees.

Aacording to the Applicant, Honorees’ fate is missed from any particular law, only PPPK existed, which actually opposed Act 13/2003 because it is permanent, while in ASN Act it always be contracted and may be extended yearly.(Lulu Anjarsari/mh/kun)
