Proceeding hearing of Act 2/2012 about land procurement, held by MK on Tuesday (9/30). In the trial, Plaintiff presented a witness named Samsudin, who was once a victim of land razzing in Depok.
Samsudin explained, the government throughout independent appraisal team forced the amount of land procurement to be paid to landowner. He said, negotiation process is not merely a negotiation, it is an unconditional one-sided agreement, without no attempt in accommodating landowners’ interest.
“Independent Appraisal Team determined the price very much below taxable value of property (NJOP), to which does in opposing favor to us,” Samsudin said.
In the other side, National Land Board (BPN) represented by Aslani Nur explained that his side always carefully settling compensation to be paid to the landowners. This effort is supported by involving independent appraisal team who settled tested 100 variables in determining amount of the consumption. BPN also declined that the settlement is premature as presumably alleged by the landowner.
In response to the landowners’ protests, the Court suggested the Plaintiffs to the district court, because the court is competent to might as well do in favor to the landowners.
Sutopo Ronodiharjo, one of the Plaintiffs, rejected the compensation because the process was not transparent, hence the result is not trustworthy.
Towards the Justice, the Plaintiff asked better compensation, regarding of their wellbeing.
As known, there are some reasons for the Plaintiff to file the judicial review of Land Procurement Act. Compensation process of Margonda-Kukusan land acquisition is not in line with Act 2/2012, Article 31 verse (1) and 2, and Article 34 verse (3).
The appraisal company is also subject for protest, due to its questioned and closed credibility. Thus the result of compensation prices in not trustworthy. In such closed circumstance, compensation price is prone to objectivity and tendencious.
The Plaintiff stated that there must be clear line, reflected in the Act, non ambiguous, because the toll road must be proceeding no matter what and so the evicted landowners not being victim of impoverishment for any longer. (Nano Tresna Arfana/mh/kun)
