Revision trial filed by Children Rights Watch Foundation (YPHA)in accordance to minimum marriage age was held on Thursday (25/9) at MK Plenary Room. The second trial was led by Justice Patrialis Akbar.
The Plaintiff said that the lawsuit has been fixed as being advised by Panel in preceding trial, some of which comprise legal standing. “Besides, Plaintiff attached minimum age trends in several muslim countries,” Supriyadi said.
In the trial, Panel of Justices has also validated attached evidences. Due to the similar Petition was filed beforehand, Patrialis said that the petition will be completed on further conjoined trial. “The next trial is testimonial hearing scheduled on the upcoming 24 September. You may register experts and witnesses,” he explained.
In the pleading, the Plaintiffs expressed that the age limit for women is in contrast to other national regulations. The Plaintiffs explained that Article 7 verse (1) and Article 7 verse (2) of the mentioned Act, has been implemented by seizing the bride’s development rights and getting proper education. Thus, it is opposing Article 28B verse (2) and Article 28C verse (1) of 1945 Constitution. Postponing marriage is a way so the women can gain higher education. According to the explanation, the ruling Act has actually and potentially harmed the Woen’s rights in having higher education. “According to the reasons, a quo requirement has determined age limitation and is discriminative as the ruling distinct men to women in bold line,” he explained.
