Constitutional Court (MK) held a judicial review trial on Article 14/1985 about Supreme Court on Wednesday (9/24) at MK hearing room. Panel of Justice led by Justice Patrialis Akbar, while the Plaintiff was represented by attorney Sutopo Simbolon.
“Today is the revision day, have you attached the revision?” Patrailis said. “We have registered it by today Your Majesty,” Sutopo said.
“We registered several Articles to set the pole. But now we only offer Article 28I verse (2) 1945 Constitution,” Sutopo said. According to Sutopo, several changes were induced to avoid nebis in idem to the Court’s verdict.
“We also call Article 67 letter b Act 14/1985 opposes 1945 Constitution, therefore we ask your discretion so the Article is subject for unbinding status,” Sutopo asked.
“We accept the revision and by this we validate the evidences you have attached,” Patrialis said
As known, in the previous trial the Plaintiff filed the petition of judicial review on Article 67 letter b Act 14/1985. The Article regulates post-verdict review can only be held if later missed determinant evidences emerged to divert the fact. According to the plaintiff, it is unclear whether what kind of evidences should be attached to bid over post-verdict review.(Nano Tresna Arfana/mh)
