Preliminary hearing of judicial review on Act 17/2014 (UU MD3) was held at Constitutional Court (MK) on Thursday (9/18). The plaintiffs are Solo DPRD members Sutrisno and former Solo DPRD member Boyamin.
The Plaintiffs argued that revised UU MD3 defies their constitutional rights. According to the Plaintiffs, UU MD3 misplaces DPRD chair election which is still running around in old way.
By the misplace ruling to be applied through DPRD chair candidacy, the Plaintiffs who are PKS and PPP members see that their chance to grab the chair is unlikely.
“Our parties are not the winning parties.” The Plaintiff said.
Therefore, they asked that DPRD chair settlement to be done by voting in DPRD instead of using old way, only member from winning party is allowed to be DPRD chair.
In response to the request, Justice Patrialis Akbar said that their plaintiffs accelerate in different direction with other reviews of same Act.
“Your pleading counters other pleadings in which asks for using old way to determine DPR chief by regarding the election result,” Patrialis said.
In the hearing, Patrialis also suggested to the Plaintiff to revise their pleading by breaking down their requests specifically and clearly, and to retain what constitutional loss they might experience by the ruling of which.(Nano Tresna Arfana/mh/kun)
