Nias DPRD Members Revised Their Pleading

Nias DPRD members revised their pleading Act number 46/2008 Judicial Review about the formation of West Nias region in North Sumatera Province. Faigiasa Bawamenewi, Waonaso Waruru, and Ronald Zai attended the hearing which was conducted on Monday (9/8) at MK plenary room.  

One accommodated advice is legal standing explanation. Previous legal standing was considered unclear as their position wasn’t explained whether on behalf Nias residents, DPRD members, or individual.

“We represent Nias DPRD, we did say that we represent the residents, but as an institution we are now representing Nias DPRD,” Faigasa said.  

Aside from legal standing, the Plaintiffs also revised their argumentation. If in the previous pleading no argument comprised Article relations to Constitution, the most recent pleading elaborates such things clearly, generating their constitutional rights luminous in return.   

Petitum is also subject for changes. They asked for annulment beforehand, as Article 3 verse (1) letter g Act of West Nias formation was seen opposing 1945 Constitution. Now, they call for a quo fixation instead.

In the preceding hearing, Faigasa explained that in the plan of West Nias formation, there are several conditions to be fulfilled, one of them is to exclude some villages in Lolo Fitu Moi District.

The conditions contained in the Form of new autonomy area issuance, signed by Nias Regent and Head of Nias DPRD. In which revealed that Lolo fitu Moi District has 13 Villages. But only 8 of them are included in the issuance. The excluded are, Ehosakhozi, Orahili Idanoi, Awela, Onombonai, and Lolofaoso.  

Although West Nias region was initiated, the five villages are willing to be included in Nias as main region, instead of being part of West Nias Region.(Yusti Nurul Agustin/mh/kun)
