Hearing of Act 20/2012 about Public Interest Land Procurement (Act of Land Procurement) was held by Constitutional Court on Monday (9/8). The agenda of the trial is testimonial hearing from the Government representative, Mualimin Abdi.
Mualimin Abdi responded to the Plaintiff’s argument in which says that Article 1 number 10 Act of Land Procurement stipulates legal uncertainty and ambiguous, especially to the definition of justice interpretation and proper category of freed land through arbitrarily process.
To the matter, the Government explained that Article 1 number 10 of Land Procurement is the definition of general requirement, not offering a chance of being reviewed due to its clear and singular meaning.
Mualimin explained, MK has also given several verdicts in accordance to general requirement review. Attachment 2 number 98, Act 12/2011 about regulation formation says that general requirement contains limitation of definition and abbreviations, applied to a article to another articles, and reflects particular principle, purposes, and interests.
“Your Majesty Panel of Constitutional Justices, in response to the Plaintiff’s argument which says that the Government has governed arbitrarily, [we deny the accusation] by explaining that the land procurement applies on four stages, planning, preparation, execution, and result handover. In the planning process, the side who needs the land must set a plan to fulfill requirement as contained in Article 15 Land Procurement Act,” Mualimin said.
“Might as well to the requirement of preparation stage, as determined in Article 16 Act of Land Procurement, land development will be publicized to the people, and implement under public consultancy,” Mualimin added.
In the execution stage, land procurement will proceed through inventorial and identification tenure, ownership, usage, and land utilization. The process can only be conducted with large public involvement to which the result will be announced. In the execution process, public meeting will be conducted for those who will determine the amount of deprivation.
“The meeting will ponder potential deprivation that will be assessed by the viewers, takes 30 days at longest by involving land-require institution,” Mualimin said(Nano Tresna Arfana/mh/kun)
