Five Brothers Reviewed KUHP Case Expiration

Judicial review of Criminal Code (KUHP) was held in Constitutional Court (MK) on Monday (9/1) at MK Plenary room. The Case was filed by Duhuaro Zega, Aroziduhu Zega, Arosokhi Zega, Aronasokhi Zega, and Arozatulo Zega.

In its Petition, the five brothers felt disadvantaged by the ruling of Article 78 KUHP. Article 78 KUHP says “(1) Authority of crime investigation removed due to the expiration: 1. All of the crimes committed after one year stamp; 2. Related to fined crime, or three-year maximum imprisonment, after six years; 3. For three-year over imprisonment, after 12 years; 4. For the lifetime imprisonment or dead sentence, 18 years. (2) For below 18-year-old convicted, each expired due decreased to third”.    

In the trial, Plaintiff expressed that his lawsuit has been revised as Panel’s discretion. “Because the lawsuit was filed after our initiative, we asked your discretion,” the Plaintiff said towards the Panel Justice, led by Justice Aswanto.

In response to it, Justice Patrialis Akbar said that the Plaintiff just have to change MK authority in their petition.

In the previous trial, Arosokhi Zega said that there was an act of faked grant deed and signature upon a house dated May 21, 2012. To the faking, the plaintiff pleaded for an objection to Nias Gunungsitoli Res.Police dated May 13, 2012. But, two years later Public Prosecutor gave back the objection due to the expiration, the case was later abandoned. However, the Plaintiff have never received the letter of expiration from Public Prosecutor.

 The situation left unclear, the disputed house is now abandoned, whereas, the house is a shelter and business booth for the plaintiff.(Lulu Anjarsari/mh/kun)
