Constitutional Court (MK) conducts preliminary hearing of 2014’s disputed presidential elections (PHPU). In the Hamdan Zoelva-led, Candidate pair number 1, Prabowo Subianto and Hatta Rajasa stated that KPU’s recapitulation as announced on July 22 has been violated.

It was delivered by the pair’s attorney, Maqdir Ismail. According to him, the pair, which supported by seven major parties gained 67.139.153 votes during the presidential election. While the rival, pair Joko Widodo and Jusuf Kalla only saved 66.435.124 votes. “We will prove after attaching all C1 forms that we’ve collected legally from more than 52.000 TPS (Polling stations),” Maqdir said at MK Plenary Room, Jakarta, on Wednesday (6/8).

Furthermore, after form DA-1 and DB-1 in all provinces and region/city have been recapitulated, he found 1,5 millions of inflated votes have been given to candidate number 2. In contrast, 1,2 millions of their votes  has wiped as shown, presumably, in 155.000 TPS. KPU is also accused to have violated several numbers of Permanent Voters List (DPT). According to the plaintiff, 4 DPT changes had been done by KPU, namely, on February 15, March 28, June 13, and July 9.

From the KPU’s decision, DPT adding on mentioned dates comprised 6.019.266 voters. “This is surpassing sensible annual population growth. The DPT has been added spectacularly for about 3.573.310 voters,” he explained.

Another objected oddity is massive voters mobilization. It is proven after unbalance numbers between ballots to used voters rights, as happened in 442 Regions/cities, 4063 Districts, 10.617 Sub-districts, and 18.670 TPS. Second, the amount between used ballots to valid and invalid ballots is different, as happened in 202 Regions/Cities, 560 Districts, 921 Sub-districts, and 1.286 TPS. “Voters in Special Voters List Addition (DPKTB) that were using KTP (Identity Card) and Passport for the registration, are bigger in number as occurred in 466 Regions/Cities, 3.750 Districts, 10.276 Sub-districts, and 20.288 TPS,” he said.

Justice’s Advice

In response to the case which registered upon number 01/PHPU.PRES/XII/2014, Constitutional Justice Ahmad Fadlil Sumadi suggests the Plaintiff to prop the arguments by attaching evidences number and names of witnesses. Justice Maria Farida Indarti also stresses out similar thing. “To make everything less complicating, should you write down to which arguments the evidences are propping, adjusted in numerical order and please complete the witnesses’ names,” She added.

Meanwhile, Constitutional Justice Aswanto asked the Plaintiff to plant solid arguments to object structured, systematic, and massive violated presidential elections. “For example, your arguments of committed money politics, you talk about indication, whereas at the same time you are asking about concrete judgment in your petitum,” he said.

Justice Arief Hidayat urges the Plaintiff, Defendant, and Related Parties to complete attorneys’ signature. “For the Plaintiff, 31 attorneys haven’t signed yet, one attorney from KPU, and 36 attorneys from the related parties haven’t signed the authority letters as well. If those letters aren’t going to be signed, they better be removed,” he said. (Lulu Hanifah/kun)
