Constitutional Court (MK) held a final hearing of Disputed Legislative Elections (PHPU Legislatif) for recalculation in Ulunoyo District, South Nias Regions. The trial which was pondering case numbered 05-14-02/PHPU.DPR-DPRD/2014 was held on Wednesday (6/8) at MK Plenary Room.

In the trial, MK corrects gained votes for all participating parties in Ulunoyo District, South Nias Region. MK also nixes KPU’s decision dated May 9, 2014 for DPRD Region/City memberships in Ulunoyo District, South Nias 3. The recalculation generates, as follow; Plaintiff (Star Crescent Party) gains 67 votes, National Democratic Party gains 121 votes, National Awakening Party gains 91 votes, Justice Prosperous Party gains 3 votes, Indonesian Democratic Party of Struggle gains 1.848 votes, Functional Group Party gains 65 votes, Greater Indonesia Movement gains 113 votes, Democratic Party gains 69 votes, National Mandate Party gains 2.614 votes, United Development Party 0 votes, People’s Conscience Party gains 178 votes, and Indonesian Justice and United Party gains 457 votes,” Head of MK, Hamdan Zoelva recited the Judgment.

Justice Patrialis Akbar cited that according to the reports and testimonies, as well as factual occurrence in trial, the Court sees that the Defendant has taken recalculation undergone as has been instructed by the Court’s Judgment number 05-14-02/PHPU.DPR-DPRD/XIII/2014, dated June 30, 2014. Moreover, in accordance to the objection filed by Plaintiff, the Court states that such objection should have been filed during the recap, hence it would be completed as the regulation has settled by the local election committees. Elections Supervisory Committees have offered good precedence to clarify signature faking of PPS letter in all over Ulunoyo.  

“According to the mentioned matters, the Court sees that the results of recalculation from the Sub-districts in all over Ulunoyo District, conducted by the South Nias KPU, can be validated. The Court will settle gained votes for DPRD Region/City membership in Ulunoyo District accordingly after Recap news event (DA Model) dated July 5, 2014 as attached in the Defendant’s report,” he said.
